The way in which we collect and process this data is outline in the Privacy Policy below.<\/p>\n<p>The purpose of the data collection is to provide rental accommodation. The processing of tenants, residents, guarantors and landlords is detailed further in the Privacy Policy for both before the commencement of the tenancy, and after.<\/p>\n<p><strong>1. Data Protection Principles<\/strong><\/p>\n<p>The Agent complies with the General Data Protection Regulation (2016\/679) and the UK Data Protection Act 2018. We use this information to help identify you and verify who you are, which is necessary when arranging a letting on your behalf.<\/li>\n<li>Background information such as previous landlord details, employer details, accountant details, next of kin, dependants and emergency contacts. We use this information to provide our service to you (i.e. arranging lettings) and to verify who you are.<\/li>\n<li>Bank account details, bank references and credit check results. We use this information to collect payment from you or send payments to you, in relation to lettings, and also to verify your ability to pay.<\/li>\n<li>Tenancy details including renewals, joint tenants, other residents and guarantors. We use this information to arrange a letting for you<\/li>\n<li>Tenancy deposit information (if any) including return on tenancy termination. We use this information to fulfil our contract with you, i.e. to ensure your deposit is kept securely and returned, where appropriate.<\/li>\n<li>Immigration\/right to rent checks (England only where applicable). We use this information to comply with our legal obligations.<\/li>\n<li>Recovery of arrears, claims or possession proceedings. We use this information to ensure that you are complying with applicable law when letting a property.<\/li>\n<li>Breach of tenancy terms\/complaints. We use this information to provide our landlord clients with a service, which is to ensure they are kept updated on the properties they are letting.<\/li>\n<li>Council Tax and utilities records. We use this information to provide our landlord clients with a service, which is to ensure they are kept updated on the properties they are letting, and to ensure that all property bills are paid in a timely manner.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"page\" title=\"Page 2\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<ul>\n<li>Notices and correspondence regarding termination of tenancy. We use this information to liaise with you regarding your tenancy.<\/li>\n<li>General correspondence in all formats (letters, emails, text messages etc). We use this information to liaise with you regarding your tenancy.<\/li>\n<li>Data sent from web browser to the Agent\u2019s server (including pages visited and time and date and duration on the Agent\u2019s server). We use this information to improve your experience on our website.<\/li>\n<li>For landlord clients, proof of ownership. We use this information to identify you and verify you are the owner of the property we will let on your behalf.<\/li>\n<li>For landlord clients: property portfolio details, including insurance information, health and safety documents, licence applications, lender restrictions, accounting and letting management records, NRL numbers. The preferences are provided either directly from the tenant or by third party agents (where provided to them directly)<\/p>\n<p>All of our properties have internal and external CCTV cameras, and will document you within\/around the property. Cloud Student Homes uses CCTV to monitor deter and investigate criminal activity and will provide to Police Agencies upon request.<\/p>\n<p>At some of our locations we have electronic fob entry systems for both building entry and\/or bedroom access. These are installed to allow you safe and secure access to your accommodations.<\/p>\n<p>In some cases, the Agent collects data about you from third parties such as;<\/p>\n<ul>\n<li>References provided by credit\/reference checks, including from previous landlords or employers<\/li>\n<li>Other tenants, residents or referral<\/li>\n<li>Guarantors<\/li>\n<li>Local authorities or Universities<\/li>\n<li>The police or other law enforcement agencies<\/li>\n<li>Letting\/managing agents<\/li>\n<li>Websites or online rental portals where the Agent advertises the accommodation<\/li>\n<\/ul>\n<p><strong>4. What do we do with the information we collect?<\/strong><\/p>\n<p>The main reason we use this information is to provide you with the website and our products and services (whether available via the website or offline) or to process contracts or to conduct legitimate business interests. Situations whereby your data will be processed by the Agent includes;<\/p>\n<ul>\n<li>To verify the identity of a proposed tenant\/resident;<\/li>\n<li>To decide on the suitability of a proposed tenant\/resident;<\/li>\n<li>To arrange lettings;<\/li>\n<li>To assess the financial standing\/suitability of a proposed tenant\/resident\/guarantor<\/li>\n<li>To check immigration status\/right to rent;<\/li>\n<li>To deal with joint tenants and residents who are linked to the tenancy;<\/li>\n<li>To enter into a tenancy agreement;<\/li>\n<li>To secure payment of rent and performance of tenant obligations;<\/li>\n<li>To collect rent and other payments;<\/li>\n<li>To manage the tenancy and the property;<\/li>\n<li>To arrange an energy performance certificate;<\/li>\n<li>To arrange an inventory check or report on the condition of the property;<\/li>\n<li>To keep accurate records relating to the Agent\u2019s rental business;<\/li>\n<li>To arrange repairs and maintenance of the property;<\/li>\n<li>To monitor and enforce performance of tenant\u2019s obligations;<\/li>\n<li>To recover debts and\/or obtain possession of a property;<\/li>\n<li>To ensure Council Tax and utilities charges are billed and paid appropriately;<\/li>\n<li>To handle tenancy termination and the return of any tenancy deposit;<\/li>\n<li>To handle complaints;<\/li>\n<li>To address health and disability issues relating to tenants\/residents;<\/li>\n<li>To create and keep audio and CCTV recordings;<\/li>\n<li>To provide information to public or local authorities who are legally entitled to require this information;<\/li>\n<li>To contact next of kin or close relatives in case of emergency;<\/li>\n<li>To store emails, records of calls and other communications;<\/li>\n<li>To comply with legal and regulatory requirements;<\/li>\n<li>To bring and defend legal claims;<\/li>\n<li>To prevent, detect and investigate crime and anti-social behaviour;<\/li>\n<li>To perform our tenancy contract to deal with joint tenants and residents who are linked to the tenancy;<\/li>\n<li>To take payment for the services provided by the Agent;<\/li>\n<li>To perform our terms of business with a landlord client; and<\/li>\n<li>To provide you with general updates in relation to the property market and information relating to the Agent\u2019sservices in accordance with your express consent. Who do we share this information with?<br \/>\nIn order to provide the appropriate services as an agent to your Landlord, and within the conditions for processing of<\/p>\n<p>personal data under legislation, we may share your information with selected third parties, and this may include;<\/p>\n<ul>\n<li>Tenancy portal for the processing of your AST, this is a secure portal that stores your personal information and controlled by password input for authorised users only<\/li>\n<li>Parcel collections\/tracking and logging. In order to provide secure collections and notifications your name, email address and room number will be processed.<\/li>\n<li>Where the Agent has a legal or regulatory obligation to provide information, including local Council\u2019s to confirm Council Tax exemptions and Electoral Roll<\/li>\n<li>Where the Agent has a legal or regulatory responsibility to provide information to a Block Management Company (where the Agent is not responsible for the block), in line with the requirements of the Building Safety Act 2022<\/li>\n<li>If the Tenant fails to pay rent, and in line with the Agents Debt Process the guarantor will be contacted from Stage2 (in line with guarantor Agreement for the outstanding rental payment)<\/li>\n<li>Where required during legal proceedings (including to a debt collection agency appointed by the Agent, and legalcounsel appointed by the Agent)<\/li>\n<li>With Emergency Contact\/Next of Kin provided by the tenant during an emergency\/concern for the welfare of thetenant, and can include severe disciplinary action<\/li>\n<li>Change of Landlord\/Agent. Where your room\/property has been sold (or in the process of sale) and transferredto a new Landlord or Landlord\u2019s Agent your details will be transferred for the continuation of your tenancy. Information relating to your rent, payment status and AST may be provided to potential buyers, their solicitors or managing agents<\/li>\n<li>In support of the Public Health England (PHE) in matters including a pandemic or outbreak in the property, and further institutional agencies as advised by the PHE to manage such an outbreak<\/li>\n<li>The Police or other law enforcement agencies where requested, and to support any anti-social behaviour plans in force<\/li>\n<li>Reference requests for continued letting<\/li>\n<li>Landlord client information with the tenant\/resident or guarantorWe will only share personal information where it is necessary, proportionate and where we have a lawful basis to do so<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"page\" title=\"Page 5\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>For tenants, residents, and guarantors, the Agent may share personal information with the landlord client (or their representative), if it is necessary to provide the service to the landlord client and fulfil the Agents obligations of service. Security<\/strong><\/p>\n<p>We are committed to ensuring that your information is secure. Linking to other websites<\/strong><\/p>\n<p>Our website or marketing email messages sometimes include links to other third party websites which are not within our control. The health of our tenants is our top priority, and this brief document sets out how we balance taking care of your welfare with the need to protect your personal information.<\/p>\n<p>Data protection law provides you with a number of rights in how your data is handled and places serious obligations on how we process this information. Under the law, information about your health is seen as particularly sensitive and additional obligations are placed on us in respect of processing or sharing this information. We have a legal duty not to share this data with anybody else, except in certain defined circumstances. As a landlord, we also need to protect the health and wellbeing of other tenants and staff that you may come into contact with, and helping you to get appropriate support is often the best way to do this<\/p>\n<p><strong>10. We Will Seek Your Consent to Share Your Personal Data<\/strong><\/p>\n<p>There are a number of grounds under data protection law that would enable us to share your personal information, and one of these is if you give your informed consent. This document explains why we want to share sensitive information about your health and we ask separately for your consent to share this information under certain serious circumstances.<\/p>\n<p><strong>11. This document has set out how we balance your right to data protection against our wish to support your wellbeing, and the wellbeing of the staff and tenants you may come into contact with.<\/p>\n<p>All information provided to Cloud Student Homes during the process of your enquiry, tenancy after is protected using internal processed and password protected systems. Full GDPR and processing training is provided to all team members handling personal data, and are processed using ICO regulations.<\/p>\n<p>Whilst the transfer of information via the internet cannot be guaranteed to be fully secure, Cloud Student Homes cannot be held responsible for information sent and the transfer of information is at your own risk. Once the information has been provided to Cloud Student Homes we use strict procedures to ensure no unauthorised access to personal data is permitted.<\/p>\n<p>Whilst Cloud Student Homes contracts with third party agents for the purpose of letting rooms, this Privacy Policy is accurate for cloudstudenthomes.co.uk and not the individual agent.
